Program of Ownership Formalization

 

The poor cannot value their property rights because of the irregular situation of their real estate inheritance.  This impedes future inheritances and also prevents the property from being taxed or sold in a normal fashion. 

According to our estimates, 70% of the poor families of the Greater Buenos Aires area lack adequate legal titles to their homes, despite having acquired the plots in the “Good Roots” real estate market through a process called “Lot Division”. 
In these cases, final payment is frequently not accompanied with a proper deed. Often, the organizations who should grant these deeds have gone bankrupt or stopped operating for other reasons.     
The Project:
The objective of the foundation is to approach the problem with rigor, identifying the basic attributes, the operating restrictions, and the size of the affected population.
Secondly, the foundation looks to identify the alternatives to overcome the problem, mobilizing political and social direction toward defining solutions that permit the poor to value their inheritance, transcending the discrimination to which they are currently subjected.
According to Law 24.374, persons who are credited public, peaceful, and continuous occupancy of urban real estate for a period of three years before January 1, 1992, and which have said real estate as their principal, permanent, and only residence, are able to request to take possession of their property through a declaration of law.     
The application of this law permits that those families without Property Title can come to an agreement to formalize their inherited real estate. 
Where to begin?
In the first application of the Title Program, the foundation is reaching out to the families who have already participated in the Support Network Trust Fund.
In this application, these families will complete a form that consists of the requisite information and documentation required by Law 24.374.
In the second application, we project to simultaneously offer the families’ connection to the Internal and External Networks along with a Property Title.
